1. Acceptance of These Terms
These Terms of Service ("Terms") govern your use of OgbDrive, including our website, Android app, PWA, dashboards, driver tools, support channels, and related services. By creating an account, booking a service, registering as a driver, using our dashboards, or continuing to use OgbDrive, you agree to these Terms and our Privacy Policy.
2. What OgbDrive Provides
OgbDrive is a transportation and logistics technology platform that helps users request ride, delivery, and haulage services and helps drivers receive and manage eligible service requests. OgbDrive may provide matching, booking, notification, support, verification, wallet/credit, and administrative tools.
Unless expressly stated otherwise, drivers are independent service providers and are responsible for their vehicles, licensing, insurance, conduct, legal compliance, and service delivery.
3. Eligibility
- You must be legally able to use transportation, delivery, haulage, payment, and online platform services in your location.
- You must provide accurate account, contact, booking, payment, and verification information.
- Drivers must meet OgbDrive's onboarding, vehicle, document, location, and verification requirements before receiving jobs.
- We may refuse, suspend, restrict, or terminate access where we believe a user or driver is ineligible, unsafe, fraudulent, or in breach of these Terms.
4. Accounts and Security
- You are responsible for keeping your email, phone number, device, login session, and OTP codes secure.
- You must not share OTPs or allow another person to use your account.
- You must notify us immediately if you suspect unauthorized access or account misuse.
- We may require additional verification before allowing sensitive changes or driver approval.
5. User Bookings
- Users must enter accurate pickup, destination, service, contact, and instruction details.
- You must be ready at the pickup location and cooperate with the assigned driver.
- You must not request transport of illegal, unsafe, restricted, dangerous, stolen, or prohibited items.
- Users are responsible for respectful conduct, timely communication, and any damage, misuse, false booking, or unlawful activity connected with their booking.
6. Driver Responsibilities
- Drivers must provide accurate personal, vehicle, license, insurance, road worthiness, proof of ownership, NIN, and other verification details where required.
- Drivers must maintain valid documentation, safe vehicles, lawful road conduct, professional behavior, and truthful online/offline availability.
- Drivers must only accept jobs they can lawfully and safely complete.
- Drivers must not bypass OgbDrive, misrepresent service status, overcharge through deception, harass users, misuse user data, or accept unsafe/prohibited jobs.
- OgbDrive may approve, reject, review, suspend, or remove drivers at its discretion based on verification, safety, performance, fraud, complaints, or legal concerns.
7. Payments, Driver Credits, Refunds, and Disputes
- OgbDrive may support driver credits, wallet balances, top-ups, booking-related payment records, refunds, and disputes.
- Payments may be processed by third-party providers such as Paystack. Their terms, security controls, and processing rules may apply.
- Driver credits are platform credits used for eligible OgbDrive services and may not be transferable, withdrawable, or refundable except where OgbDrive expressly allows or applicable law requires.
- Payment failures, reversals, chargebacks, incorrect references, or suspected fraud may result in delayed service, wallet adjustment, suspension, or manual review.
- Refunds, where available, may be reviewed based on transaction records, booking status, service completion, fraud checks, and provider timelines.
8. Location, Notifications, and Communications
OgbDrive may use location information, push notifications, email, SMS/OTP-style messages, WhatsApp-related service messages, and in-app notices to operate bookings, driver availability, support, security, and service updates. You can control certain permissions through your device, browser, or app settings, but disabling them may limit some features.
9. Support, Safety, and Incident Handling
- You must report booking issues, safety concerns, payment problems, document issues, or misconduct through support channels as soon as possible.
- OgbDrive may review support tickets, booking records, driver documents, messages, payment records, location records, and administrative logs to resolve incidents.
- For emergencies, accidents, crime, injury, or immediate danger, contact local emergency services first, then notify OgbDrive support.
10. Prohibited Conduct
- Fraud, impersonation, false accounts, false documents, forged records, or misuse of another person's information.
- Harassment, abuse, threats, discrimination, violence, exploitation, or unsafe behavior.
- Illegal transport, unsafe delivery items, contraband, weapons, stolen goods, or prohibited substances.
- Attempts to hack, scrape, reverse engineer, overload, bypass, or interfere with OgbDrive systems.
- Sharing user, driver, booking, payment, or support information outside legitimate service needs.
- Bypassing OgbDrive payment, booking, support, verification, or safety processes.
11. Documents, Uploads, and Content
You are responsible for files, photos, documents, messages, and other content you upload or submit. You must have the right to provide them, and they must be accurate, lawful, and not harmful. We may remove, restrict, or review uploaded content that appears invalid, unsafe, unlawful, fraudulent, or inconsistent with platform requirements.
12. Suspension and Termination
We may suspend, restrict, or terminate accounts, driver profiles, wallet/credit access, bookings, or platform features if we believe there is a policy violation, safety risk, fraud risk, legal issue, payment dispute, verification failure, or misuse of the platform.
13. Account Deletion
You may request account deletion through the app where available or through our Account and Data Deletion page. Deletion may remove your account and associated app data, subject to retention required for legal, payment, safety, fraud-prevention, tax, accounting, dispute-resolution, or regulatory reasons.
14. Third-Party Services
OgbDrive uses third-party services for authentication, hosting, uploads, maps, payments, email, push notifications, WhatsApp-related messaging, analytics, or platform operations. Your use of these features may also be subject to the relevant third party's terms and privacy practices.
15. Disclaimers and Limitation of Liability
OgbDrive is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted access, error-free operation, availability of drivers, delivery times, earnings, service coverage, or successful completion of every booking.
To the maximum extent permitted by law, OgbDrive will not be liable for indirect, incidental, special, consequential, punitive, or loss-of-profit damages arising from your use of the platform, except where such limitation is not allowed by applicable law.
16. Changes to These Terms
We may update these Terms when we change our services, legal requirements, payment model, driver requirements, or platform operations. Continued use of OgbDrive after an update means you accept the updated Terms.
