By accessing and using OgbDrive's website, mobile application, and services (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform.

2. Description of Service

OgbDrive is a ride-hailing and haulage platform that connects riders with drivers. We operate as a technology platform and are not responsible for the quality, safety, legality, or any other aspect of services provided by independent drivers. Drivers are independent contractors, not employees of OgbDrive.

Services include:

• Ride-hailing services (cars, kekes, dynas, etc.)
• Haulage and goods delivery services
• Towing and emergency services
• Payment processing
• Customer support

3. Eligibility

To use OgbDrive, you must:

• Be at least 18 years old
• Have a valid phone number and email address
• Reside in Abuja, FCT, Nigeria (or service area)
• Have the legal authority to enter into these Terms
• Comply with all applicable laws and regulations
• Not be a competitor or engaged in prohibited activities

4. User Accounts

4.1 Account Creation

You are responsible for providing accurate information when creating your account. You agree not to create multiple accounts or impersonate others.

4.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and password. You agree to notify us immediately of any unauthorized access or use of your account.

4.3 Suspension or Termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or pose a safety risk. Termination is effective immediately upon notice.

5. Riders' Responsibilities

As a rider, you agree to:

• Be at pickup location on time or notify driver of delay
• Treat drivers and vehicles with respect
• Not engage in illegal activities or carry prohibited items
• Not eat, drink, or smoke in the vehicle
• Follow driver instructions for safety
• Pay the agreed fare promptly
• Provide accurate destination information
• Not record or photograph without consent
• Report any accidents, damage, or safety concerns immediately

6. Drivers' Responsibilities

As a driver, you agree to:

• Maintain a valid driver's license and vehicle registration
• Keep your vehicle clean, safe, and well-maintained
• Have valid insurance coverage at all times
• Obey all traffic laws and safety regulations
• Arrive at pickup location within reasonable time
• Treat riders with courtesy and respect
• Provide safe and efficient service
• Not engage in discrimination or harassment
• Report accidents and safety incidents immediately
• Maintain current documents and certifications

7. Pricing and Payments

7.1 Fare Calculation

Fares are calculated based on:

• Base fare per ride type
• Distance traveled
• Time spent (waiting time included)
• Surge pricing during peak demand
• Applicable taxes and fees

7.2 Payment Methods

Accepted payment methods include cash, cards, mobile wallets, and bank transfer between drivers and Ogbdrive other payments are direct payments between user and driver which could be any methods agreed between both parties.

7.3 Cancellations and Refunds

• Rider Cancellation: Free cancellation before the arrival of the driver
• Driver Cancellation: Driver may cancel before pickup without penalty
• Service Issues: Refunds for incomplete or failed services may be issued at our discretion
• what we refund: Refunds are only inform of credits for drivers when an accepted trip is cancelled

8. Safety and Liability

8.1 Safety Features

OgbDrive provides safety features including:

• Stored trip details
• Driver verification and background checks
• Rating and review system
• 24/7 support availability

8.2 Insurance Coverage

All vehicles include insurance.

8.3 Limitation of Liability

OgbDrive is not liable for:

• Personal injuries or property damage during rides
• Lost or stolen items (use our lost and found service)
• Indirect, incidental, or consequential damages
• Third-party actions or omissions
• Service interruptions or technical failures
• Delays due to traffic or weather

9. Prohibited Activities

You agree not to use OgbDrive for:

• Illegal activities or transporting illegal goods
• Harassment, discrimination, or abuse
• Violence, threats, or dangerous behavior
• Fraud, scams, or deception
• Recording without consent
• Drug or alcohol use while using services
• Sexual harassment or misconduct
• Spamming or unsolicited marketing
• Interference with platform operations
• Violating any laws or regulations

10. Intellectual Property

All content on the OgbDrive platform, including logos, text, images, and software, is owned by or licensed to OgbDrive and protected by intellectual property laws. You may not reproduce, modify, or distribute this content without permission.

11. User Content

By submitting reviews, feedback, or other content to OgbDrive, you grant us a worldwide, non-exclusive, royalty-free license to use this content. You represent that you own or have permission to submit this content and that it does not violate any laws or third-party rights.

We reserve the right to remove any content that violates these Terms.

12. Dispute Resolution

12.1 Informal Resolution

In case of disputes, we encourage you to contact our support team first at support@ogbdrive.ng to attempt informal resolution within 30 days.

12.2 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration under Nigerian law, rather than in court. Each party bears its own legal fees.

12.3 Class Action Waiver

You agree not to pursue claims on a class action or representative basis. All disputes must be brought individually.

13. Termination

OgbDrive may terminate or suspend your account immediately without notice if:

• You violate these Terms
• You engage in illegal activity
• You pose a safety risk
• You engage in fraud or deception
• Your account is inactive for 12+ months

14. Modifications to Terms

We may update these Terms at any time. Continued use of the Platform constitutes acceptance of modified Terms. We will notify you of material changes via email or prominent notice.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflicts of law principles.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and OgbDrive and supersede all prior agreements and understandings.
